Welcome to Meal Planner & Grocery List (the "App", "we", "our", or "us"). Please read these Terms and Conditions ("Terms") carefully before using our application and related services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
1. Description of Service
Meal Planner & Grocery List provides a digital platform that allows users to organize, save, and manage recipes ("Services"). The App acts solely as a personal recipe management tool and a conduit for users to import content from third-party sources for their personal use.
2. User Accounts

  • Registration: You must provide accurate and complete information when creating an account.
  • Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User Content and Intellectual Property
"User Content" refers to any text, images, recipes, links, or other materials you upload, import, or otherwise make available through the App.

  • Your Responsibility: You are solely responsible for your User Content. We do not pre-screen, verify, or endorse any recipes or content imported or uploaded by users.
  • Grant of License: By uploading or importing User Content into the App, you grant us a worldwide, non-exclusive, royalty-free license to host, store, use, display, and reproduce that content solely for the purpose of operating, developing, and providing the Services to you and other users (if you choose to share it).
  • Representations and Warranties: You represent and warrant that:
    1. You own the User Content or have all necessary licenses, rights, consents, and permissions to use and to authorize us to use the User Content.
    2. Your uploading, importing, or sharing of the User Content does not infringe upon or violate the intellectual property rights (including copyrights and trademarks), privacy rights, or any other rights of any third party.

4. Acceptable Use Policy
You agree not to use the App to:

  • Violate any applicable local, state, national, or international laws or regulations.
  • Import, upload, or share content that infringes upon the copyright or intellectual property of others.
  • Attempt to reverse engineer, decompile, hack, or disable any part of the App.
  • Use any automated means (such as bots, scrapers, or spiders) to access, extract, or scrape data from our App without our express written permission.

5. Copyright Infringement and DMCA Notice
We respect the intellectual property rights of others and expect our users to do the same. If you are a copyright owner and believe that content hosted on our App infringes your copyright, please submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") or applicable European copyright directives by providing our Copyright Agent with the following information in writing:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and where it is located on the App (e.g., the URL).
  • Your contact information (address, telephone number, and email address).
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.

6. Indemnification (User Liability)
You agree to defend, indemnify, and hold harmless Jojo Apps BV, its affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the App.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right relating to your User Content.

7. Third-Party Links and Services
The App may allow you to access or link to third-party websites. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused by your use of any third-party content.
8. Disclaimer of Warranties
THE APP AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Jojo Apps BV BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS APP.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

11. Apple App Store Additional Terms
If you download the App from the Apple App Store, you and we (Jojo Apps) acknowledge and agree to the following additional terms required by Apple Inc. ("Apple"):
1. Acknowledgement: These Terms are concluded between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
2. Scope of License: The license granted to you is a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions (including Family Sharing).
3. Maintenance and Support: We are solely responsible for providing maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services.
4. Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.
5. Product & IP Claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your use of it (including product liability, legal compliance, and consumer protection). In the event of any third-party claim that the App or your use of the App infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
6. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
7. Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
8. Third-Party Beneficiary: Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
